  4. Full License Agreement 
  5. THIS IS A LEGAL AGREEMENT BETWEEN YOU AND DIGITAL VISION LTD. BY BREAKING THE SEAL ON THE
  6. PACKAGING, YOU AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE, PROMPTLY RETURN
  7. THE CD IN THE ORIGINAL PACKAGING FOR A FULL REFUND.

  9. GRANT OF LICENSE. Digital Vision Ltd grants you the non-exclusive, non-transferable license
  10. to use and modify the images. The term "images" for the purpose of this license is deemed
  11. to include all illustrations, photographs, digital animations, film clips, videos or other
  12. visual and or auditory representations recorded in any format on the CD. 
  13.  
  14. This license is subject to the restrictions contained herein. The images may not be copied
  15. in their entirety. You may not rent, transfer or grant any rights to the images contained
  16. herein, or any compilation, derivative or collective work containing such images to any
  17. other person or organization without prior written consent of Digital Vision Ltd. You may
  18. not use this product on more than one computer or workstation at a time, nor on a network
  19. or a multi-user system.

  21. This license agreement DOES PERMIT the following uses of the images. You may use these
  22. images in your personal, professional, internal, editorial and client projects including
  23. printed materials, advertisements, packaging, presentations, television, film, video,
  24. on-line or multimedia projects. This license agreement DOES NOT PERMIT the following uses
  25. of the images. You may not post any image or images from this disc on any electronic
  26. bulletin board, put the images on-line in a downloadable format, or use the images in a
  27. website at a resolution higher than 72dpi. You may not use, or allow anyone else to use any
  28. of these images to create pornographic, libelous, obscene or defamatory images.

  30. Using an image or images from this disc in a way not covered or specifically prohibited by
  31. this agreement, without prior written consent from Digital Vision Ltd, is a violation of
  32. Federal copyright law. This license is in force until it is terminated. If you do not comply
  33. with the terms and conditions above, this license automatically terminates. At termination,
  34. the product must be returned to Digital Vision Ltd immediately. 
  35.  
  36. COPYRIGHT. All images are owned by Digital Vision Ltd. or its licensors and are protected by
  37. the United States Copyright laws, international treaty provisions and other applicable laws.
  38. No title to or intellectual property rights to any Digital Vision image is transferred to
  39. you. Digital Vision Ltd. retains all rights not expressly granted by this license agreement.

  41. LIMITED WARRANTY. DIGITAL VISION LTD WARRANTS THE IMAGES TO BE FREE FROM DEFECTS IN MATERIAL
  42. AND WORKMANSHIP FOR 90 DAYS FROM DELIVERY. YOUR SOLE AND EXCLUSIVE REMEDY FOR A BREACH OF
  43. THIS WARRANTY IS THE REPLACEMENT OF THE IMAGE OR A REFUND OF THE PURCHASE PRICE, AT THE
  44. OPTION OF DIGITAL VISION LTD.

  46. DIGITAL VISION LTD MAKES NO OTHER WARRANTY EITHER EXPRESSED OR IMPLIED, OF MERCHANTABILITY,
  47. FITNESS FOR ANY PARTICULAR USE OR COMPATIBILITY WITH ANY COMPUTER OR OTHER KIND OF EQUIPMENT.
  48. NEITHER DIGITAL VISION LTD, OR ANY OF ITS TRUSTEES, AGENTS, EMPLOYEES, REPRESENTATIVES OR
  49. ASSOCIATES SHALL BE LIABLE FOR ANY DAMAGES.

  52. GOVERNING LAW AND GENERAL PROVISIONS This Agreement will be governed by the laws in force in
  53. the State of California excluding the application of its conflicts of law rules. This
  54. Agreement will not be governed by the United Nations Convention on Contracts for the
  55. International Sale of Goods, the application of which is expressly excluded. If any part of
  56. this Agreement is found void and unenforceable, it will not affect the validity of the
  57. balance of the Agreement, which shall remain valid and enforceable according to its terms.
  58. You agree that the Software will not be shipped, transferred or exported into any country or
  59. used in any manner prohibited by the United States Export Administration Act or any other
  60. export laws, restrictions or regulations.

  62. This Agreement shall automatically terminate upon failure by you to comply with its terms.
